“Maintain status-quo” SC to Delhi HC direction to put Indian Olympic Association under CoA

New Delhi, Aug 18 : The Supreme Court on Thursday ordered status quo, after being informed by the Indian Olympic Association (IOA) that the Delhi High Court appointed committee of administrators (CoA) has not taken over the management of the body’s national organization that is a member of the International Olympic Committee.
The IOA had filed a petition with to the Supreme Court challenging a Delhi High Court order of setting up an administrative committee of administrators (CoA) to oversee the day-to day governance.

Solicitor General Tushar Mehta, representing the IOA in the courtroom, told an apex court composed of Chief Justice N.V.Ramana that the problem is affecting the entire country and that the IOA is a member of the International Olympic Committee.Mehta claimed that as per the international committee, an elected body is required to represent the association.If the IOA is represented by a non-elected entity then it is considered to be third interference from a third.”India has a 99 percent chance of being disqualified from participation in an international Olympic event .,” said Mehta saying that it is an issue of national prestige.

The Supreme Court said, “We ask parties to keep the status-quo.

it is clarified that the case has not been transferred.Bring it to the proper judge next Monday.”

The Supreme Court has scheduled the matter for a further hearings on Monday.Prior to that, in the day Mehta made the case to the Chief Justice N.V.Ramana.Mehta said that in the world of sports, such committees of administrators are considered to be ‘outsiders’.The Supreme Court agreed to hear the issue later in the day.

FIFA the world’s top football body, has suspended the All India Football Federation (AIFF) due to influence from third parties, threatening the nation’s hosting of the World Cup U-17 for women in October.The AIFF will not be able to participate in any international match until the suspension is lifted.Justice Anil R.Dave is also the head of the CoA appointed by the highest court to oversee the administration of AIFF.

In the last week the high court made a statement in order to enhance the “ecosystem” of sports organizations and improve their structure, and place the administration of the Indian Olympic Association (IOA) in the control of the Committee of Administrators (CoA) in accordance with an earlier Supreme Court order.

The court also ordered the Centre not to confer recognition or facilities to the Indian Olympic Association or any National Sports Federations (NSFs) in the event that they fail to adhere with the Sports Code.

“.the legal system governing the administration of sports in India must be fully and effectively implemented.

“Compliance with the Sports Code is not negotiable,” a division bench of Justice Najmi Waziri and Justice Manmohan said in an order.

In accordance with the court order, the Committee of Administrators — Justice Anil R.Dave, former Judge of the Supreme Court, Dr.S.Y.Quraishi, IAS, former Chief Election Commissioner, and Vikas Swarup IFS Former Secretary Ministry of External Affairs will oversee the day-to day administration of IOA.
