J&K HC orders reopening of 2003 Nadimarg Kashmiri Pandit massacre case

Srinagar the 31st of August : In response to an application from the UT government the Jammu and Kashmir and Ladakh High Court has ordered reopening of the Nadimarg massacre case in which 24 Kashmiri Pandits were killed by LeT terrorists in Pulwama district on March 23, 2003.
The application, filed by the UT government through the prosecution sought to revoke of an earlier decision which dismissed the criminal revision petition decade ago and effectively ended the case.

The high court has granted the order that the trial resume on the 15th of September.

Masked LeT terrorists in uniforms of the army had robbed the Nadimarg village during the night of March 23rd, 2003.

There were there were around 52 Kashmiri Pandits despite the exile of most of their population from the Valley in the early 1990s.

The terrorists had arranged 11 men and 11 women and two infants who were killed with the volley of automatic firearms.

A lot of those terrorists who were involved in the murders were killed or were captured in the years following.

Seven suspects were arrested following an investigation.

The investigation was then transferred to the Shopian sessions court.It ruled against an appeal to examine of witnesses and evidence during the course of the trial.

The prosecution had claimed at the time in its application that witnesses had moved from the Valley of the Valley and were hesitant to appear in the court because of fear.

The lower court ruled that the review petition was not within its jurisdiction.

The high court then denied the petition for revision on December 21, 2011.

Then, a brand second application was made in 2014.

“For the reasons mentioned above the petition of prosecution is granted and the decision dated 21.12.2011 that this court made is being recalled.The registry is instructed to publish the revised petition for rehearing by 15.09.2022,” Justice Sanjay Dhar declared in his decision.
