New Delhi, Aug 27 : Expressing his deep displeasure with the ‘complete absence of consideration and diligence from officers’ Delhi Lieutenant.Governor V.K.Saxena has slammed the Directorate of Education (DoE) and has highlighted the ‘insensitive and unprofessional attitude of DoE officials that has resulted in unneeded litigation’.
In deciding an appeal in favor of one of the elementary schools whose accreditation was refused by the DoE in spite of the school meeting all the necessary requirements and requirements, the L-G found that the department charged with the task of the development of schools in Delhi has demonstrated a complete inattention and lack of attention and diligence.

“The Education Department is expected to facilitate the process and not be an obstructionist” the LG has declared.

This judicial decision will dismiss the appeal that was filed in accordance with section 4(3) of Delhi Education Act 1973, in conjunction with the rule of 58 of Delhi School Education Rules 1973, which names the Lieutenant.Governor of Delhi as the Judicial Appellate Authority, against the impugned order of 16.07.2019 that was issued by the Director Deputy of Education, District North-West (B), GNCTD.

The mentioned order of the Director’s Deputy been announcing the decision of Director DoE in denial of the appellant’s demand for granting of recognition until the elementary level.

The case was considered by the L-G on the 27th of July and the counsel of the appellant i.e.Ganga International School Rohini as well as the respondents i.e.Directorate of Education, GNCTD and Delhi Development Authority (DDA) were also present.The LG took the lawyer of the appellant.

After hearing the arguments from both sides after hearing the arguments of both sides, the LG observed that with the exception of the perpetual lease deed, in which the area of the land allotted to the society is shown as 798 sq.m.All other documents from DDA refer to a land area of 800 sq.m.

The LG directed the DoE to immediately grant the school with required recognition, which has been in the process from 2009 (13 years) subject to the school meeting all other requirements and requirements.LG noted that the disputed order issued by the DoE is unclear, non-verbal and was made without the use of mind.

The LG also noted that it was on basis of the sponsorship provided by DoE that the school has applied for land with DDA.Therefore, it would be prudent on the part of Director (Education) to seek clarification in the issue from DDA prior to denying the application for recognition.

Additionally, after the land was first surveyed and weighed at 802.49 sq.meters.in 2021 by DDA and the DoE had no reason to do with the challenged order, as the LG was informed according to the source.

According to the source LG Saxena has instructed that all officers or officials who are performing statutory functions in the context of the regulations of the Delhi Education Act & Rules 1973 will issue directions/orders under their own signatures in the near future.
