New Delhi, Aug 25 : The Supreme Court on Thursday sought an answer from the Gujarat government on a petition seeking the release of 11 men who were found guilty of the gang-raped of Bilkis Bano as well as multiple murders in the 2002 Gujarat protests. The Supreme Court explained that it was not able to give permission for the convicts to be released rather, it requested the government to look into.
A court headed by the Chief Justice and comprising Justices Ajay Rashogi and Vikram Nath ruled that the crime was horrifying is sufficient to conclude that remission is not right?
The Gujarat government released the convicts on Independence Day, which has caused a major political controversy.
Justice Rastogi asked senior advocate Kapil Sibal, who was representing the petitioners “Day in and day out, remissions are granted to those who are convicted of life sentences, what is the exemption (in this case)”.
After hearing arguments, highest court issued a notice to the Gujarat government.
The Supreme Court clarified that the order of May 2022 simply stated that the remission or early release should be evaluated in the context of the policy in effect in the state in which the crime occurred.”I found a source that said that the court granted permission for the remission. The court, however, said that it would only consider the case,” noted the bench.
The court heard a petition by CPI-M MP Subhasini Ali, journalist Revati Laul and Professor Roop Rekha Verma.
