3 Cong MLAs are granted the conditional permission for them to be allowed to return to J’khand

Kolkata 5 Sep : A division bench of the Calcutta High Court on Monday granted a conditional permit to the three Congress MLAs from Jharkhand -who were detained in West Bengal with a large sum of money in July to be allowed to return to their home state.
The Calcutta High court’s division bench of Justice Joymalya Bagchi and Justice Bivas Pattanayak has ruled that three MLAs — Irfan ansari from Jamtara, Rajesh Kacchap from Khijri (ST) and Naman Bixal Kongari of Kolebira (ST) are permitted to return to Jharkhand only to take part in any session of the assembly of the state.

However, before they leave West Bengal, these three MLAs must notify that the Criminal Investigation Department (CID) of state police, and also provide an original copy of the letter from the Jharkhand assembly inviting them to attend in any session to provide evidence.

The division bench has also made a ruling that all three MLAs have to return to Kolkata within 24 hours of their participation in any session of the Jharkhand assembly has ended.

To remember to recall, on the evening of July 30th, 2022, the MLAs were found with bags of bank notes in Ranihati in Howrah district of West Bengal.After the notes were counted the total value was discovered to be Rs 48 lakh.

The three MLAs were traveling in an SUV with two of their associates.

Based on of intelligence-based information, West Bengal police had apprehended the suspects.

The SUV was registered with the number of Jamtara MLA of Jharkhand.According to reports, the MLAs detained by police could not provide specific information regarding the money found in the car.

After a few rounds of legal discussions before the Calcutta High Court, the three MLAs were granted bail on the 17th of August.However, the court prohibited the three MLAs from leaving Kolkata until further orders.

Recently the three MLAs once again called the Calcutta High court’s division bench of Justice Bagchi and Justice Pattanayak with an appeal to be allowed to attend during the Jharkhand assembly sessions.

Based on the merits of this on that basis, the High Court gave conditional approval to their appeal.
