Nalini, a convict in the Rajiv Gandhi assassination, appealed to the apex court in opposition to the Madras High Court order, which ruled against her plea, saying that it was not able to exercise the powers pursuant to Article 142 of the Constitution to make the same order.The same order was approved by the Apex Court to release another suspect, A.G.Perarivalan, in the case.”The instructions requested by the petitioner can’t be granted by the court, since it is not able to exercise powers similar to those that the apex court is granted pursuant to Article 142 of the Constitution of India.In light of the above reasons, the petition is dismissed as unsuitable” the supreme court in an order issued on the 17th of June.

On May 18 on May 18, the Supreme Court invoked its extraordinary powers to ensure justice in accordance with Article 142 of the Constitution and ordered the release of A.G.Perarivalan, sentenced to life imprisonment in the murder of the former prime minister Rajiv Gandhi.

A bench of Justices L.Nageswara Rao (retired in the present), B.R.Gavai and A.S.Bopanna stated: “in the exceptional facts and circumstances of this case, in exercise of our authority pursuant to Article 142 of the Constitution We direct that the Appellant be considered to have completed the term of his sentence in connection with the crime.The appellant, who is currently being held on bail, will be placed free immediately”.Perarivalan is currently in a bail bond.The sentence of death was reduced to a life imprisonment, and terrorism charges were dropped.

The court of appeals considered Perarivalan’s lengthy period of being in jail, his excellent behavior in prison and parole, chronic illnesses based on the medical records of his, his academic qualifications he gained during his time in prison and the indefiniteness of his application pursuant to Article 161 for two and half years following the advice of the cabinet of state.The court’s ruling was upon Perarivalan’s plea for remission.
