New Delhi, Sep 2 : The Supreme Court on Friday declined to consider a PIL asking for the detention of Yati Narsinghanand, and Jitendra Tyagi, formerly known as Waseem Rizvi for making incendiary or insulting remarks about Islam as well as the Prophet and the followers of Islam.A bench comprised of Chief Justice U.U.Lalit and Justice S.Ravindra Bhat stated that such a plea could not be considered in accordance with the Article 32 of the Constitution.
The bench instructed the counsel representing the petitioner, that “You would like someone to be detained and pursued pursuant to Article 32.?.Have you filed a complaint?
“If we do, then what happens to the Lalita Kumari judgement?”
The counsel suggested that he could drop the petition asking for arrest and that the court could consider additional petitions in the petition.
The bench reaffirmed: “These are not petitions that cannot be considered in accordance with Article 32.”
Rejecting the petition, the court declared that the petitioner is at the liberty of seeking remedies that are appropriate.
The petition also sought an end to the book written by Tyagi “Muhammad”.”The book, as well as its cover and its contents are extremely harmful to the feelings of those who follow the religion of Islam.of Islam.They are a scourge to the followers of the religion of Islam and are incendiary and libellous in the nature of it and can cause harm to the very foundation of religious harmony and unity in India,” said the petition, signed by Indian Muslim Shia Isna Ashari Jamaat.
The plea also requested a direction to prevent Tyagi and Narsinghanand from making “derogatory, insulting and incendiary’ comments about Islam Prophet Mohammed and the idols of the faith.
The plea was made by advocate Sachin Sanmukhan Pujari and advocate Farrukh Khan.
The petitioner cited a number of instances in which the two made statements in opposition to Islam and tried to inflame community tensions and controversies and identified Tyagi and Narsinghanand as a threat to the security and integrityof the harmony of society and public peace.
