A court in Maharashtra allowed a request for a private hearing on the bail application of television actor Sheezan Khan, who was arrested for allegedly abetting the suicide of his co-star Tunisha Sharma.The prosecutor requested an in-camera hearing to protect the parties’ privacy, and the court granted the request.
The jailed actor’s lawyer argued in favor of bail for his client and contested the charge of abetment of suicide, claiming that the section of the Indian Penal Code did not apply to the case.The prosecutor opposed the bail plea and cited a doctor’s certificate indicating that Tunisha Sharma was suffering from obsessive-compulsive disorder.
The court did not grant bail to Sheezan Khan and scheduled the next hearing for March 2, when the prosecutor will continue their arguments.The actor was arrested in late December after Tunisha Sharma allegedly committed suicide by hanging herself on the set of a TV serial near Valiv in Palghar district.
Actor Sheezan Khan is presently in jail under judicial custody.
During a hearing on his bail plea, lawyer Sharad Rai argued before Additional Sessions Judge SM Deshpande at Vasai in Maharashtra’s Palghar district that the section 306 of the Indian Penal Code, under which his client Sheezan Khan has been booked by the police for allegedly abetting the suicide of his co-star Tunisha Sharma, does not apply to the case.
The lawyer further stated that since the investigation has been completed, and a chargesheet filed, the accused should be released on bail.Khan and Tunisha Sharma, who were allegedly in a relationship, had a breakup later.
The case has a Special Public Prosecutor, Sanjay, and Tarun Sharma is representing Tunisha Sharma’s family.
The judge postponed the hearing to March 2 at the request of both More and Tarun Sharma to allow them to make their submissions.A conviction under section 306 of the Indian Penal Code can attract a jail term of up to ten years.
