SC rejects Central Vista’s request for land-use changes

New Delhi : , Tuesday, November 23rd, 2009: The Supreme Court rescinded Tuesday a petition challenging the change in land use at Central Vista from residential to recreational for the official residence.
Justice A.M.Khanwilkar, a bench that heard petitioner Rajiv Sui’s argument, asked Rajiv Suri if he thought the suggestions of ordinary people should be considered for the decision on where the house of the vice-president.

Suri was further questioned by the bench, who said that Suri had claimed that the Centre proposed that the land be converted into a residential area for the vice president.This is an official policy decision.

It was illegal, the bench demanded.The mala fides are what?

Counsel for the petitioner argued that authorities should search other sites, and green areas should not be destroyed.

It was noted that the Centre had stated that it will increase overall green space.The bench observed that, despite the fact that the area was used as recreational land in the past, it must be kept as such.

At least the appropriate amount of space should have been allocated elsewhere.

This cannot fall within the scope of judicial reviews.

The authority in question has the right to make changes in their development plans.This is policy, said the bench.

Centre asked the Supreme Court not to grant the petition challenging the notification of change of land use.This would have a devastating effect on Delhi residents.The Centre stated that the affected area is currently being used by government offices for the past 90 years.Any loss of greenery can be compensated.

Advocate Shikhil Suri filed the plea claiming that Centre had malafidely sent notification on October 28, 2020 notifying of the change of land use.This will make Delhi residents without access to a large portion of Central Vista open space, which is highly valued for recreational and social activities.

This plea was made in support of Article 21 Right to Life.The right to a wholesome and happy life.
