New Delhi, Aug 9 : The debate surrounding an issue involving the Maharashtra State Board of Wakfs is not going away since Attorney General K.K.Venugopal has sent a second letter to the Supreme Court claiming that somebody is determined to ensure that he does not present arguments in the case.
He has also requested the adjournment in the case until the time he recovers from the effects of Covid-19.

The AG’s letter of August 8, addressed to the Secretary General of the apex court stated: “Looking at the entirety of what has transpired it appears that whoever is responsible for the events that occurred regardless of whether they are the recipients of the transfer, or someone else determined to ensure that Attorney General doesn’t contest the case.”

“It is requested that the letter be submitted to the Chief Justice of India in order that the current batch of cases can be remanded until I regain my health and be able to be present in the matter.”

The issue is whether every charitable trust set up by an Muslim person is Wakf property.The case is before an apex court comprised of Chief Justice N.V.Ramana for Wednesday.

On August 1st on the 1st of August, the AG had sent an open letter to the Supreme Court to take strong opposition to the decision that was taken by the Wakf Board.

“All this interfering with counsel who are supposed to represent the parties who are removed at the last moment is a grave, unjustified and unjustified attempt to interfere in the proper process of justice by taking counsel representing the parties off the case.

This is clearly an act of infraction of the court,” said the AG, in his letter to the Registrar (Judicial).

On August 2nd, a bench comprised of Chief Justice Ramana, expressed discontent with Maharashtra Wakf Board for trying to replace Attorney General in the capacity of counsel in the case in the middle of hearing on a key issue – whether all the property donated by Muslims for charitable purposes would fall under Wakf.

The Chief Justice stated: “This is not correct.is this the right way to handle the AG.”

Venugopal who was on the show virtually on the internet, stated that “yesterday there was a note that said I do not represent (the Wakf Board ).This has not yet occurred”.

The Chief Justice said: “This is not the method in which you must conduct yourself with the AG.”

The AG requested the highest court to consider the letter so that appropriate actions is taken.

The Bombay High Court had quashed an Maharashtra government circular establishing the Wakf Board and a notice of properties that fall under Wakf.The Maharashtra State Board of Wakfs filed a petition with before the Supreme Court challenging the high court’s order.
