The Supreme Court on Friday upheld the Andhra Pradesh High Court order that struck down GO 115 issued by the state government to take back the land given to a Visakhapatnam-based businessman.
The state government had earlier allotted 17,135 square meters of land to Katragadda Lalitesh Kumar in Marripalem area of Visakhapatnam.
However, the government of Andhra Pradesh later issued GO 115 cancelling the allotment.
Challenging the State government’s decision, Lalitesh Kumar filed a petition in the High Court of Andhra Pradesh challenging the Governement Order.
A single bench of the High Court struck down the GO.On an appeal subsequently, a full bench headed by Chief Justice P.K.Misra endorsed the decision of the single judge.
Following this, AP government had then filed a petition in the Supreme Court challenging the High Court order.
On Friday a Supreme Court bench comprising of judges, Justice Dipankar Dutta and Justice Pankaj Mittal upheld the High Court order.
The apex court observed that it is not a good decision on part of the AP government to take back a land that it has already allotted to a person.
