New Delhi, Sep 12 : The Supreme Court on Monday granted bail to Jitendra Tyagi previously called Wasim Rizvi, accused for giving alleged inflamatory speeches to Muslims in Dharam Sansad.A court of Justices Ajay Rastogi as well as B.V.Nagarathna directed Tyagi not to engage in these allegations anymore and to provide an assurance before the trial court he will not engage in discussions with social media or electronic media.In the last week of August the apex court denied Tyagi’s temporary bail granted on medical grounds and directed the defendant to surrender.
The top court on Monday said that the supreme court ruled that Tyagi should appear before the trial court in three days, and he is to be granted bail under conditions and terms to the delight of the court.
It clarified that in the event that he violates one or more of bail conditions, prosecution can make an application for the cancellation of the bail.
On May 17th the Supreme Court had granted interim bail for three months to Tyagi who was detained in connection with anti-Semitic remarks during the Haridwar Dharam Sansad held in December of last year.
The Supreme Court made a condition that Tyagi would not engage in hatred and make an apology to media outlets.
The top court had directed counsel for Tyagi to request his client not to engage in hateful speech, as harmony must be maintained in the society.
Uttarakhand government counsel told the court of top appeal that Tyagi could only be released on bail in the event that he was able to change his ways, and also reassured that he will not be making hateful remarks.
The state government also stated that if a person wants to talk about their religion, that is not a problem however, one should not engage in hatred speech towards other religions.
In January the Uttarakhand Police arrested him for inciting a riot at a party in Haridwar.
