New Delhi, Sep 6 : The Supreme Court on Monday said the state and Central governments are not able to guarantee security to private hospitals or nursing homes that function as businesses in the course of hearing of an application seeking directions for security for healthcare professionals and doctors, susceptible to attack by relatives of patients and others.A bench of Justices S.K.Kaul and A.S.Oka said the private hospitals are charged a lot and are able to manage of security problems on their own and also questioned the petitioner’s lawyer What is the government’s plan to ensure security for the many private nursing homes and hospitals?
Senior Advocate Vijay Hansaria, representing the Delhi Medical Association, said the healthcare professionals and doctors are at risk of attack and stressed the need to have an effective security mechanism.
The bench explained to Hansaria that in large cities, each lane will have a medical center and how could it issue generic orders?
“You cannot think that the government will put in an security program for private gamers.”
The bench demanded details on concerns and representations to the state governments, as they weren’t in the petition.in the petition.
It was observed that it is not feasible for the apex court control the security of its patients and it is not able to give directions on what type of security must be provided to private hospitals.
The bench said that the attack on doctors is unjust and that whenever attacks occur it is because of a certain flaw in the system in place.
The court said that the provision of security to a government hospital is an executive decision, and it’s not the responsibility of the court to decide in this area.
It stated that it was not going to give any directive for the government to provide security for private hospitals because they are business entities.
Hansaria requested permission to amend her petition.The request was granted by the judge.
The DMA demanded directions to provide adequate security in hospitals and medical centers to avoid attacks on healthcare professionals by family members of patients and other individuals.The complaint was filed through the advocate Sneha Kalita.
