Patna 23 August : A constitutional crisis erupted in Bihar on Tuesday following Assembly Speaker Vijay Kumar Sinha refused to quit his post despite the no-confidence motion against his nomination.The ruling JD-U and RJD filed the motion of no-confidence against Sinha following their accession to the throne in Bihar.
Sinha turned down the motion of no confidence and claimed that it wasn’t in compliance with the law.Accordingly, he had decided not to resign his position.
Following the formation of the government in Bihar, Bihar’s BJP was transformed into an opposition political party.This is why the ruling JD-U and RJD were contemplating that Sinha could resign his post.
According to the law, an advance notice of a motion to remove the Speaker’s confidence the Speaker must be made in the Assembly and the vote must take place within 14 days.
“After the formation of an entirely new government in Bihar the parties that are ruling Bihar need to show that they have the majority in the house.
It will take place on Wednesday in an extraordinary session.Since I’ve already voted against the motion of no confidence against me, debate will not be held on the motion.
In the next session, I’ll bring my arguments in the room,” Sinha said.
Vice Speaker Maheshwar Hajari said: “Sinha is a BJP leader and he does not have the majority in the House to stay in the constitutional office.We’ve already submitted an online notice regarding no-confidence motions on the 9th of August and then physically filed the notice on the 10th of August.Therefore, if he did not request vote in the House within 14 days, he would not be the speaker of Bihar Vidhan Sabha from August 24.”
“During his time as Speaker, he was an advocate of keeping morality in the House.When it is up to him, he forgets those morality and sits firmly on the constitutional throne,” he added.
