Kolkata 22nd August : A division bench of Calcutta High Court on Monday ordered the petitioner in the PIL on cattle trafficking in West Bengal to expunge the name of Amit Shah, the Union Home Affairs Minister Shah from the petition.The division bench, which includes the Chief Justice Prakash Srivastava and Justice Rajarshi Bharadwaj said that since the plaintiff in the relevant PIL has no personal allegations against the Home Minister in the matter His name should be removed from the PIL.
The bench also ordered the petitioner to file a second petition in the matter within the next three days.
The plaintiff in the case advocate Ramaprasad Sarkar, known for his close ties to Trinamool Congress, filed the PIL asking how cattle smuggling across the border continue with Amit Shah as the head of operations in the Home Ministry.
The petitioner further argued that as Home Minister, Shah’s job is to examine the function of the Border Security Force (BSF) in managing cattle smuggling across borders, and he must acknowledge his responsibility in the issue.
However the division bench did not agree with the argument of petitioner, and demanded Shah to file a new petition to remove Shah’s name from the list.
