New Delhi, Sep 7 : The Supreme Court has granted interim bail, based on medical reasons for a period of eight weeks for a murder suspect who was being treated for cancer.A bench of Justices Indira Banerjee and M.M.Sundresh stated: “From a certificate issued by the Public Information Officer and the Jail Superintendent, Central Jail, Jaipur it is evident that the petitioner suffers with CML-CP (Chronic Myeloid Leukamia).The weight of the petitioner is 48 kilograms.
“He does not appear to be in a condition to work and needs rest.
This request for interim bail was granted on medical grounds to assist in care of the petitioner”.
Petitioner Nahar Singh was represented by a criminal attorney Namit Saxena.
After hearing Saxena’s arguments, the court of appeals ruled: “On overall consideration of the facts and circumstances of the case, and in particular the health of the petitioner, we believe it appropriate to grant the petitioner granted bail in interim for the period of eight weeks subject to such conditions and conditions as could be granted by the Sessions Court.The petition for special leave is accordingly to be disposed of.In the event of any pending applications are to be being disposed of.”
Saxena stated before the bench that the petitioner is sick, and bleak, and is declining day by day .He also claimed that he is suffering of CML-CP, as well as tuberculosis.”Despite the constant treatment provided to him, while he is in the prison, there is not an change in the health of the petitioner.The treatment given to the petitioner is not adequate and the petitioner should be allowed to be released under bail in order to enjoy his right to remain well and be treated in an appropriate manner and in accordance with his preferences,” said the plea.
