San Francisco, Aug 31 : Tesla CEO Elon Musk is trying to get more time with the court in order to start the Twitter trial, scheduled for October 17 due to the testimony scheduled by whistleblower Peiter “Mudge” Zatko.Musk’s legal counsel has suggested a new schedule that would extend the trial from a week to late November.
“Delaware Court of Chancery Judge Kathaleen McCormick has not yet made a decision on the request, or even proposed an alternative timetable,” The Verge reported late on Tuesday.
Zatko will be a witness at US Congress on Wednesday, September 13, over claims he made against the Parag Agrawal-led micro-blogging site.
The previous Twitter security chief claimed that Twitter was misleading regulators about its security procedures and the actual amount of bot accounts.
Zatko was also served with an order from the legal team of Musk to appear in deposition on the 9th of September in the ongoing suit between Twitter and Musk.
Musk has stated that his testimony of Twitter whistleblowers is the reason for his reversal of the deal worth $44 billion that he signed to purchase the micro-blogging site.
In a new termination notice submitted with the US Securities and Exchange Commission (SEC) Musk’s legal team stated that Zatko’s claims, if real, “demonstrate that Twitter has violated the following terms of the Merger Agreement, thereby giving the Musk Parties the power to end the Merger Agreement pursuant to its conditions”.
Musk must show the court that Twitter did not comply with a particular provision of the merger agreement or else he will be forced to pay an estimated $1 billion fine to cancel the deal.
