The Appellate Tribunal for Electricity (Aptel) has dismissed a petition filed by Tata Power.It also upheld the Maharashtra electricity regulator’s decision to award transmission contract worth Rs 7,000 crore to Adani Power on nomination basis.
Aptel in its order has said that there is no merit in the arguments made by the appellant, therefore, Aptel dismisses the objections of RTM route made by MIRC with respect to the project.The Maharashtra Electricity Regulatory Commission has chosen the RTM (Regulate Tariff Mode) route under section 62 for reasons which cannot be said to be wrong, distorted or unreasonable.
However, Tata Power is expected to move the Supreme Court against Aptel’s decision.The case is expected to be a milestone that is keenly watched by industry groups and sets a benchmark in cases where transmission contract awards have been submitted for bidding.
Tata Power had approached Aptel against the grant of voltage transmission lines to Adani Electricity Mumbai Infrastructure (AEMIL) by the Maharashtra Electricity Regulatory Commission (MERC) without bidding.Tata Power protested that the mega project to build a 1,000-MW high voltage direct current (HVDC) link between Kudus and Aarey should be awarded through the transparent bidding route.
As provided under section 63 of the Electricity Act and National Tariff Policy.The order said that there is no reason for this tribunal sitting in appeal to change the views of the commission as there may be some reasons to exercise the other option under section 63.Aptel said this is an age-old scheme which all the planners and stakeholders consider important for the power-starved Mumbai region and interference by the tribunal would be wrong, regressive and counterproductive.MERC had in March last year allotted 100 per cent Special Purpose Vehicle (SPV) of Adani Electricity Mumbai Limited to AEMIL under RTM as the company took steps towards acquisition of land for development of the project.
