DOJ declares it will appeal Florida judge’s decision regarding a special master

By Ashe O Washington 9th, September : The Department of Justice has asked the Florida Judge Aileen Cannon to stay the part of her ruling that halted the investigation by requiring the presentation of classified documents to a designated master and confirmed the decision that it “will appeal in the event that she does not comply with the request”.

The US Department of Justice responded on Thursday to the controversial ruling issued on Monday by the former US president Donald Trump’s appointed judge Aileen Cannon, who appointed an individual master to supervise the documents confiscated at Mar-a-Lago.

“The DOJ files notice of appeal in the case of the judge effectively stopped the Trump investigation into documents and imposed an individual master to filter documents to protect executive privilege.” New York Times correspondent Charlie Savage reported.

“The DOJ is asking the judge to stay the portion of her order that stopped the investigation.The judge would have to require the submission of classified documents to the special master and vows to appeal in the event that she fails to do so.”

Legal experts have said that this is a clever decision from the DOJ to continue their investigation without hampered.The filing outlined an urgent need to find out the information in the folders without a header with headings for classification.

“The same is also true of the folders that were empty with “classified banners” that were among the confiscated documents here,” the DOJ argued.

“The FBI would be chiefly responsible for determining what documents might have been stored in these folders and if they were lost or damaged — steps which, in turn, could need the use of grand jury subpoenas and search warrants and other investigative tools that could provide evidence that could be extremely relevant to the criminal probe,” news reports stated.

The filing stated that Trump had “never ever disputed” the fact that he “has no possession, property or other legal right in classified documents.”

Alan Kohler, Jr.The vice director of the FBI for counterintelligence, has also provided a six-page statement in the support of the DOJ’s request.

Legal experts immediately used social media to discuss the prosecution’s decision.

Former Department of Justice spokesperson Matt Miller stated: “The DOJ firing its most powerful bullets in this case: Cannon’s order has already forced (Office of Director of National Intelligence) to stop risk assessments and any further delay could further undermine national security.

The lawyer for the national security Bradley Moss wrote: “This DOJ motion reiterates the same thing over and over again I’ve been saying on CNN and MSNBC for the last three days There is nothing for the Special Master to deal with documents that have classification markings.They are property of the government.They are not part of Trump.”

Former Solicitor General acting Neal Katyal said, “This is extremely clever.”

“This is a smart move from the DOJ,” wrote former federal prosecutor Renato Mariotti.”This allows Judge Cannon an opportunity to rethink the most problematic portions of her decision, thereby avoiding appeal and keep the investigation moving.”
