Kolkata on 22 August : The issue of the payment of the pending dearness allowance (DA) arrears to West Bengal government employees, that has been engulfed with controversy for some time and took a drastic change on Monday with an in contempt of the court that was filed against the state’s government.In the petition filed before the division bench of Justice Harish Tandon and Justice Rabindranath Samanta, the Confederation of State Government Employees has stated that the original deadline stipulated by the court for settling the DA arrears to the state government expired on the 19th of August and the state government has still not making any progress on this issue.
Therefore, the petitioner claimed that this is akin to infraction of the court.
The bench of the division has approved the petition and the case will be heard on the 24th of August.
On August 12 the state government submitted an appeal with the same bench, urging it to reconsider its previous decision of May 22 this year, and to conclude the process of the payment of outstanding DA arrears due to the state government before the 19th of August according to the requirements of the West Bengal Services (Revision of Pay and Allowance) Rules, 2009.
The confederation filed a contempt of court petition on Monday.
filing its contempt of court petition also claimed that the state government didn’t provide the version of the review petition as an entity in the matter , which is against the law.
To remember the first time the confederation had submitted a petition to the State Administrative Tribunal (SAT) seeking the payment of outstanding DA arrears in the amount of 32 percent.The SAT decision was in favor of the employees of the state government.
The state government contested the SAT order before an appeals bench of the Calcutta High Court.
After a lengthy legal dispute The division bench also in an order dated May 22 of this year, confirmed the decision of SAT and ordered the state government to finish the process of paying of the pending DA arrears in three months.
