SC reconstitutes SIT; appoints Lakhimpur Kheri case (Ld).

New Delhi, November 17, 2017 : .The Supreme Court said Wednesday that it was concerned with ensuring an impartial investigation.

It appointed Justice Rakesh Kumar Jain to oversee the Lakhimpur Kheri violence inquiry.He is a former judge at Haryana High Court and Punjab High Court.

The top court also reconstituted the SIT investigating the incident and appointed IPS officer S.B.S.B., an IPS officer was also appointed by the top court to restructure the SIT that had been investigating the incident.Shiradkar as its head.Shiradkar was appointed its chief.
During the hearing, a bench headed by Chief Justice NV Ramana said: “We appoint Rakesh Kumar Jain (retired judge of Punjab and Haryana High Court).to ensure absolute impartiality in the investigation of the case.”.During the hearing, a court headed by Chief Justice NV RAMana stated: “We appoint Rakesh Kumar Jain (retired judge of Punjab High Court ).) to guarantee absolute impartiality during the investigation into the case.”

The bench, in its order, said: “This court is equally concerned about guaranteeing an impartial, fair, just and thorough investigation into the incident which has resulted in such a tragic loss of lives of protesters as well as some other persons.”.In its decision, the bench stated that it was equally concerned with ensuring an impartial, fair and just investigation of the incident, which led to such tragic deaths of protesters.

The bench, also comprising justices Surya Kant and Hima Kohli also expressed its disapproval of the slow pace, manner and outcome of the investigation conducted so far, as well as the composition of the SIT charged with investigating the matter.

According to the bench, justice Jain was appointed to oversee the ongoing investigation to insure transparency, fairness, and absolute impartiality of the final outcome of the Lakhimpur Kheri investigation.The investigation is time-bound.

“We thus deem it appropriate to reconstitute the SIT hereinafter to preserve the faith and trust of people in the criminal administration of the justice system,” said the top court.The top court stated that it was appropriate to reconstitute SIT “hereafter in order to preserve faith and trust among people involved with the criminal administration of justice system.”

It further added: “We, therefore, deem it appropriate to direct reconstitution of the SIT infused with directly recruited IPS officers who do not hail from the state of Uttar Pradesh though are allocated to UP cadre.”.The SIT was further reconstituted with directly recruited IPS officers, who are not from Uttar Pradesh but have been allocated to UP cadre.

The short-listed officers of the SIT are — S.B.S.B.are the short-listed SIT officers.Shiradkar IPS, Batch RR 1993 ADG Intelligence HQ, hailing from Nanded, Maharashtra (Head of SIT); Padmaja Chauhan, IG, IPS RR 1998; and Preetinder Singh, DIG, IPS RR 2004.Shiradkar IPS Batch RR 1993 ADG Intelligence HQ hailing from Nanded (Head SIT); Padmaja Chauhan IG, IPS RR98; and Preetinder Sing, DIG.IPS RR2004.

The bench said the newly constituted SIT shall be free to seek assistance from, and/or associate with or include the local police of Lakhimpur Kheri for taking the ongoing investigation to its logical conclusion under the continuous monitoring of the judge.

According to the bench, the SIT will be free to ask for assistance and/or associate with the Lakhimpur Kheri police to continue the investigation.This is under continuous surveillance by the judge.

“The SIT shall make all efforts to conclude the investigation expeditiously and file the chargesheet,” said the court, and directed the Uttar Pradesh government to provide all assistance to the monitoring judge.The court directed the Uttar Pradesh government, in addition to providing all support to the monitor judge, to “The SIT shall endeavor to close the investigation expeditiously”

The violence occurred on October 3, resulting in the killing of eight persons, including four farmers who were allegedly mowed down by the vehicles in the convoy of Ashish Mishra, the son of Union Minister and BJP MP Ajay Kumar Mishra.

Eight people were killed in violence on October 3.
