SC approves interim bail for Amrapali Group ex-CMD on health basis

New Delhi, Aug 8 : The Supreme Court on Monday granted an interim bail period of four weeks for medical reasons to the former Amrapali Group Chairman and Managing Director Anil Kumar Sharma.
On the 4th of August, the highest court had issued a notice regarding Sharma’s request for bail on medical reasons.A bench led by Justice U.U.Lalit requested the Additional Solicitor General Aishwarya Bhati to file a report on Sharma’s medical condition .They set the issue to hear on August 8.

On Monday, the highest court that granted interim bail demanded Sharma to surrender following the expiration of 4 weeks.

In the last hearing, Sharma’s lawyer presented evidence to the highest judge that the client’s health was declining and requested that it allow the bail of Sharma for between six and eight weeks while keeping in the view of his medical health.

Sharma is currently incarcerated in Mandoli prison in the city of Mandoli.

Amrapali Group’s former directors, which includes Sharma are in jail after numerous cases were filed against them for taking home buyers’ money.

The Supreme Court on June 9 allowed Sharma’s operation to be carried out at the All India Institute of Medical Sciences (AIIMS) to repair of the “bilateral inguinal hernia” within one week.But, recognizing that the allegations against Sharma are serious, the court did not consider the counsel’s plea seeking bail for a period of four weeks.

The SC had ordered the Enforcement Directorate probe into the possible money laundering allegedly committed through the realtor.

On the 21st of March the court had ruled that it was not appropriate to order the clubbing and transfer of several cases brought against Amrapali directors and other executives of the group’s businesses.

The lawyer of Shiv Priya who is one of the Amrapali officials behind bar, made a submission before an apex court comprised of Justice Lalit that trial in more than 80 criminal cases can be transferred to a single court from seven courts in the capital.

Refusing to transfer or club the case, the court stated that every complainant will have their own versions, which will cause issues for the court and the judge in the trial court concerned will have a difficult time to render the judgment.

As counsel pointed out the clubbing of issues in the coal scam, the judge stated that cases involving coal scams involved officials from the government as the accused, as well as the Prevention of Corruption Act provides transfer and clubbing of cases.Counsel emphasized that the core of all FIRs is that homebuyers were frauds.
