Chandigarh : , Tuesday, November 23rd.The Punjab and Haryana High Court ruled on Tuesday that a purchaser of Chandigarh’s floor can become either a co-owner/sharer or co-owner in any building remaining in joint ownership. A division bench consisting of Justices Tejinder Singh Dhindsa, Vivek puri ruled that conversion of residential plots to apartments is permissible.
The bench stated that the purchaser does not become a co-owner of the whole site or building, but he or she will be able to share in it.
The bench dismissed a number of petitions in the event of dispute among co-owners and co-sharers.
The purchaser/vendor must include similar stipulations in their affidavit at execution, registration and at the point of filing transfer requests for entry of mutation in the purchaser’s name in the records at the estate office.
These stipulations should also be included in the transfer letter that will be issued by estate office.
High court heard petitions for conversion of residential plots to apartments.
An investigation based on a high court order found that 891 sales deeds had been registered between 2016 and 2019.These were where property was sold to someone other than the family.
According to the petitioner, Chandigarh’s residential plots were intended for single-dwelling units.These were sold to multiple buyers in recent years.This added burden placed additional strain on the infrastructure.
Chandigarh’s administration claimed that they did not permit floor-wise sales of properties.
