Chennai, November 12, : , Around 237 lawyers wrote a letter protesting the appointment of Chief Justice Sanjib Banerjee of Madras High Court to Chief Justice of Meghalaya High Court.Chennai, Nov 12, 2012 : Approximately 237 lawyers sent a protest letter to Supreme Court Collegium opposing Sanjib Banerjee being transferred from Madras High Court Chief Justice to Meghalaya High Court Chief Justice.
The lawyers in the letter pointed out that Justice Sanjib Banerjee had served Madras High Court as Chief Justice only for ten months and that whether the transfer was for ‘public interest’ or for ‘better administration of justice’, the two factors that are taken into consideration regarding the transfer of a judge.In the letter, lawyers pointed out Justice Sanjib Banerjee’s tenure as Madras High Court Chief Justice was only ten months.

They also asked whether it was in the ‘public interest or better administration of justice to transfer a judge.Lawyers in the letter noted that Justice Sanjib Banerjee was Chief Justice of Madras High Court for only ten month and suggested that the transfer be made for the ‘public good’ or ‘better administration.

These are the factors to consider when transferring a judge.

Lawyers in the letter to Collegium asked, “While transfers for better administration of justice may be necessary in principle, members of the Bar have a right to know why a competent, fearless judge and an efficient administrator of a large High court where more than 35,000 cases were filed this year be transferred to a Court where the total number of cases instituted in a month is on an average of 70-75”.

Collegium lawyers wrote to ask why transfers of justice might be required in principle.However, Bar members have the right to understand the reasoning behind a competent and fearless judge, an efficient administrator, of a high court with more than 35,000 cases this year, being transferred to a Court that has an average of 70-75 cases per month.

Collegium was contacted by lawyers who asked why transfer of justice could be needed in principle.Members of the Bar are entitled to find out the reasons for a fearless and competent judge being moved to another Court with a lower average number of cases each month.

The letter also stated that Justice Sanjib Banerjee had assumed office as the Chief Justice of Madras High Court on January 4, 2021, and is expected to retire in November 2023.It was also mentioned that Justice Sanjib Banerjee, Chief Justice of Madras High Court, had taken office on January 4, 2021 and will be retiring in November 2023.

In the letter, Justice Sanjib Banerjee was addressed and stated that he had been appointed Chief Justice at Madras High Court in January 2021.He is due to retire in November 2023.

The lawyers also said, “The recommendation to appoint him as the Chief Justice of Madras High Court was made less than a year back in December 2020 obviously after considering his experience as a judge of the Calcutta High Court and suitability to head a Chartered High Court.They also stated that the recommendation to appoint him Chief Justice of Madras High Court in December 2020 was less than a calendar year ago, clearly after taking into account his past as a judge at the Calcutta High Court as well as suitability for the head of a Chartered High Court.

According to the lawyers, the decision to appoint him to the position of Chief Justice Madras High Court Judge was made in December 2020.This recommendation came less than a full year before.

It had been made after considering his experiences as a Calcutta High Court judge and ability to lead a Chartered High Court.It is therefore inexplicable that the Collegium should revise its opinion and recommend a transfer.”Therefore, it is inexplicable for the Collegium to revise and recommend a transfer.The Collegium shouldn’t have revised its decision and recommended a transfer.

The letter also stated that such a transfer damages the reputation of an honest judge and lowers the image of the judiciary before the eyes of the public.In the letter, it was stated that such a transfer would damage the reputation of an honest judge as well as lower the image of judiciary in the eyes of public.

The Madras High Court lawyers said that Justice Sanjib Banerjee had in a recent order dismissed a Public Interest Litigation seeking to prevent the Chief Minister of Tamil Nadu from chairing an advisory committee under the Hindu Religious and Endowment (HR&CE) Act until he takes a pledge in front of a Hindu God in a nearby temple.Madras High Court lawyers stated that Justice Sanjib Banerjee, in a recent Order, had dismissed an Intl Litigation seeking the prohibition of the Chief Minister of Tamil Nadu being able to chair an advisory panel under the Hindu Religious and Endowment Act (HR&CE Act) until he makes a vow in front of a Hindu God at a temple nearby.

Madras High Court attorneys stated that Justice Sanjib Banerjee had, in a recently dismissed Public Interest Litigation to stop the Chief Minister Tamil Nadu from preside over an advisory committee under Hindu Religious and Endowment Acts (HR&CE Acts) up until he pledges in front a Hindu god in a nearby temple.

The Lawyers requested the Collegium to reconsider the decision to transfer Justice Sanjib Banerjee from Madras High Court, which is a chartered court having sanctioned strength of 75 judicial officers to Meghalaya court that was formed in 2013 with a current strength of two judges.
