Chennai, November 16, : , The Supreme Court Collegium has made the decision to move Chief Justice Sanjib Banerjee of Madras High Court to Meghalaya High Court.
A statement from the Justice Department, Government of India on Monday read, “In exercise of the power conferred under the Constitution of India, Honourable President of India in consultation with Hon.On Monday, the Justice Department, Government of India released the following statement: “In exercising the power conferred by the Constitution of India Honourable president of India in consultation.The Chief Justice of India is pleased to transfer Justice Sanjib Banerjee, CJ Madras High Court as CJ Meghalaya High court.”.It is with pleasure that Justice Sanjib Banerjee from CJ Madras High Court has been transferred to CJ Meghalaya High Court.

The legal fraternity of the Madras High court was holding protests against the transfer of the Chief Justice to Meghalaya High Court.Protests were held by the legal fraternity at Madras High Court against the transfer to Meghalaya High Court of Chief Justice.

The lawyers contended that Justice Sanjib Banerjee had assumed office as the Chief Justice of Madras High Court only in January 2021 and that his transfer only after serving ten months in Madras High court was unfounded.Lawyers claimed that Justice Sanjib Banerjee was the Chief Justice at Madras High Court and had only assumed office in January 2021.

They also claimed that he was transferred only after he served ten months in Madras High Court.

Retired Judges and senior lawyers had questioned the wisdom to transfer Justice Sanjib Banerjee from the Madras High Court, which is a chartered high court with a strength of 75 judges, to a relatively low profile high court like Meghalaya which has a sanctioned strength of only four judges.

Senior lawyers and retired judges questioned whether Justice Sanjib Banerjee should be transferred from Madras High Court (a chartered high-court with 75 judges) to Meghalaya High Court.This high-profile high court has only four approved judges.

A total of 237 lawyers of the Madras High court had sent a letter to the Collegium requesting it to reconsider the decision to transfer Justice Sanjib Banerjee.Total of 237 Madras High Court lawyers had written a request to the Collegium asking it to reconsider its decision to transfer Justice Sanjib Banerjee.31 designated lawyers of the High court had also sent a letter to the Collegium seeking to know the reason behind the transfer.31 lawyers from the High court also wrote a request to the Collegium to find out the reasons behind the transfer.Madras Bar Association (MBA) and Madras High Court Advocates Association (MHAA) had also sent request letters to the Collegium to reconsider the decision.Madras Bar Association and Madras High Court Advocates Association had sent requests letters to the Collegium asking for reconsideration of the decision.

Justice Sanjib Banerjee was a favourite among the advocates for his forthright comments and judgments with a stamp of authority.Justice Sanjib Banerjee is a favorite among advocates because of his direct comments and authority-based judgments.

He has been a strong votary for the cause of environment and in all the cases related to environmental and river degradation, he used to personally hear the cases and to intervene.His strong support for environmentalism is evident.

He used to listen to the cases in relation to river and environmental degradation and to make interventions.

He had also taken a strong stand in some judgments, including the one during the recent Assembly elections in April in which he had warned the Election Commission of India that murder charges could be invoked for its failure to take proper precautions in enforcing Covid norms.

He also took a firm stand on some judgements.This included the April Assembly election judgment in which he warned the Election Commission of India about the possibility of murder charges for failing to follow Covid norms.

The Collegium, which had taken the decision to transfer Justice Sanjib Banerjee to the Meghalaya High court on September 16, made it public only on November 9.After the Collegium had made the decision on September 16 to move Justice Sanjib Banerjee from Madras High Court to Meghalaya, it was made public on November 9th.Justice Sanjib Banerjee is the third Chief Justice of Madras High Court since 2018.Justice Sanjib Banerjee has been the Chief Justice at Madras High Court for three years.
