Lok Sabha debates Bill to amend higher judiciary’s service conditions and salaries

New Delhi : , Tuesday, December 7, 2018 – The Lok Sabha took up the Amendment Bill 2021 to the High Court and Supreme Court Judges’ Salaries and Conditions of Service (Salaries and Conditions of Service) Bill.Several members raised concerns over the high number of cases pending.

<br/ The Bill was introduced by Kiren Rijiju, Law Minister.Last week Shashi Tharoor (Congress member) raised the question of retirement age for judges in top courts.He noted that there are an alarming amount of cases pending.<br/ <br/ BJP's P.P.Chaudhary, in turn, asked the government to reconsider the appointment process for judges.<br/ <br/ Kalyan Banerjee, Trinamool Congress, stated that India added 23 cases per minute in the past two years.<br/ <br/ Our justice delivery system is facing severe problems today.While debating the Bill, Banerjee said that 5.8 million cases were pending in the High Courts.He said that more than 51,000 cases were pending at the High Court in Rajasthan, and many cases are still pending at the Fast-Track courts.<br/ <br/ Trinamool's leader claimed that the Bharatiya Janata Party is close to some lawyers, and collegiums recommended three female lawyers recently.However, they weren't made judges.<br/ <br/ "Is Article 144 of Constitution not being violated by the Central government?" He also asked about the unprecedented press conference that four Supreme Court judges held to highlight the dire state of the justice system.He said, "Then one went on to be the Chief Justice in India" and he also added that he was a Rajya Sabha Member after he retired.<br/ <br/ V Geethaviswanath, a member of YSR Congress Party pointed out the absence of female judges in the judiciary as well as a lack of Judges from Scheduled Castes or Scheduled Tribes.

<br/ <br/ A apt reservation policy would make the judiciary more inclusive.She also argued for the strong need to reform Collegium.

<br/ <br/ She added that "An All India Judicial Service should be established, similar to Civil Services." <br/ <br/ Arvind Ganpat Sawant, Shiv Sena's president, stated that 10-12 names had been recommended by Maharashtras governments around eight months back.

However those names are still not cleared yet by Governor."Where is justice?" He asked.<br/ <br/ Mahabali Singh, Janata Dal-United's president, stated that although he supports increasing judges' pensions it is becoming a common trend for them to become part of other government agencies after retirement.He said, "We must ensure that these judges don't receive multiple pensions.

" <br/ <br/ He said the Collegium system was not constitutional, and asked who would be responsible for all the pending cases.<br/ <br/ Shyam Singh Yadav, BSP's spokesperson, asked why the Bill did not mention the retirement of judges who have served more than 95 years.

He said that the Government believed judges could not live beyond 95 years.However, he added that it was better for the Bill to mention judges who have been in office over 90 years.<br/ <br/ The discussion was inconclusive.On Wednesday, the Minister will respond and try to pass the bill.
