New Delhi, Nov 27, : , President Ram Nath Kovind stated on Saturday that judges must exercise the utmost discretion inside courtrooms.Indiscret remarks, even if made with good intentions, can allow for dubious interpretations to undermine the judiciary.
Kovind, in his address to the Supreme Court at the Constitution Day programme’s valedictory function, expressed joy that the Indian judiciary had been following the highest standards.

He stated, “There is no doubt you have set yourself a high standard.

Judges are also expected to be discreet in their statements in courtrooms.Even if they are made with good intentions, indiscreet remarks can allow for dubious interpretations that can undermine the judiciary.

Citing Indian tradition, he said that judges are a model for rectitude and detachment.This is more in line with’sthitpragya,’ a person of steady wisdom.

The President stated that India has a rich history with legions of such judges, who were well-known for their extraordinary utterances and impeccable conduct.These are hallmarks for future generations.

He said that justice is the pivot around which democracy revolves.It gets even stronger if the three institutions — the judiciary, legislature, and executive — live in harmony.

“In the Constitution, every institution has its own defined space within which they function.He said that the journey of our Republic was glorious, with the exception of an emergency period in which there was a brief aberration.

In the case of “Dennis against the United States”, the President also quoted Justice Felix Frankfurter from the US Supreme Court.

Justice Frankfurter stated that courts are not representative bodies.

They are not intended to be a good representation of democratic societies.Their essential quality is detachedness founded on independence.

Citing the US judge, the President said that history has shown that courts can become enmeshed in passions and have to choose between competing economic, political, and social pressures.

The President expressed his dismay at the comments made about judges on social media and said: “It hurts me to no end.There have been some instances of disparaging remarks made about the judiciary on social media platforms.While these platforms are great for democratizing information, they also have their dark side.Some criminals exploit the anonymity they provide.I hope this is an aberration and it will be brief-lived.

Kovind stated that he is firm in his belief that the independence and impartiality of the judiciary are non-negotiable.

He asked, however, “Without diluting the principle to the slightest degree, is there a better way to select judges for the higher judiciary?”

The President stated that an all-India judicial system could be created which can choose, nurture, and promote the right talent at all levels.

He also stated that the idea isn’t new and has been around for over 50 years without being tested.
