Panaji 22 Nov : .The petition for disqualification filed by Girish Chodankar, president of Goa Congress against 10 Congress MLAs that quit in 2019 has been placed on the list for final disposition on December 10, said Vivek Tankha, Rajya Sabha MP and Chodankar. Tankha appeared in Goa before the Bombay High Court.He also stated that another party, ‘Goa Forward,’ had filed a petition to support the Plea filed by Chodankar.
The High Court sent new notices to Rajesh Patnekar, the Speaker Rajesh Patnekar, and 10 MLAs for their responses.
Counsel stated that both petitions have been combined for disposal.
“The Advocate General, counsel for the Speaker was present.The matter is now listed for final disposition on December 10.All parties must complete their pleadings before that.By December 9, all parties must have completed their pleadings.
Tankha stated that everyone will be heard by the HC on December 10.
Chodankar had in his petition argued that the separation of 10 Congress MLAs, and then their merger with the BJP were illegal and violated the provisions of Schedule 10 to the Constitution.
Chodankar approached Speaker Patnekar after he had dismissed an oral disqualification petition against Chodankar’s ten MLAs.
Tankha stated that the defections are a problem in democracy, and that everyone should work together to end them.
“But, beyond the High Court’s statements, I want to reiterate our commitment for democracy and our commitment towards an ethical government.Tankha stated that defections should not be allowed.
He also said that my party and I believe it to be a deadly disease.
He said, “So as a party we should do all that is within our power to provide clean and effective administration and governance, and have a defector free government.”
