New Delhi, Sep 9 : The Supreme Court on Friday granted the Gujarat government two weeks to file a response to appeals to the release of 11 men found guilty of the gang-raped of Bilkis Bano and a string of murders in the 2002 Gujarat violence.
A court of Justices Ajay Rastaghi and B.V.Nagarathna directed the Gujarat government to submit all records that provided the basis for the granting of an remission to all defendants in the case.The court asked the Gujarat government to submit its response within two weeks.It also demanded advocate Rishi Malhotra who represents a few of the accused to file a reply.

During the hearing, supreme court was asked whether notice should be given in the second case in the event of a similar petition with the same basis of action.

Malhotra filed “multiple petitions were made by those with no “locus” and I am not in favor of the impleadment process.They are simply multiplying petitions and impleadment application in every aspect.”

The bench stated that the matter cannot be resolved of without a notice being issued and issued a notice to Malhotra in the matter.It also asked him to follow instructions in the event that he was able to appear for the other defendant in the trial.

The petitioners were asked to hand over a copy of the petition on Malhotra and counsel representing the Gujarat government.

The highest court also ordered the Gujarat government to put all relevant documents including the remission orders as well as the remission order, on record.The court also ordered a follow-up hearing within three weeks.

On August 25 on, the Supreme Court sought a response from the Gujarat government regarding a plea opposing the release of 11 convicts, and then clarifying that it had not granted permission for remission for the convicts.Instead, it requested the government to look into.

The court heard an application filed by CPI-M’s former MP Subhasini Ali, journalist Revati Laul and Professor Roop Rekha Verma.Trinamool Congress MP Mahua Moitra has also filed a petition with the highest court in the case.

Eleven convicts sentenced to life prison were released from the Godhra sub-jail on 15 August when the Gujarat government permitted the release of these prisoners under its Remission policy.The convicts served more than 15 years in prison.

In January 2008 the special CBI court in Mumbai had sentenced the convicts for life imprisonment for gang-rape as well as the murder of seven of the members of Bilkis Bano’s family.The Bombay High Court upheld their conviction.

Bilkis Bano was 21 years old and was pregnant for five months when she was raped by gangs in the course of fleeing the violence that broke out following the Godhra train caught fire.

The PIL which was brought by Ali and others, challenged the decision of the authority in charge of the Gujarat government, by way of which 11 individuals who were convicted in a series of grave crimes were permitted to be released on the 15th of August 2022, pursuant to a remission extension to the accused.

The petitioners argued that the they claimed that the granting of relief solely through the authority of a state government without consult with the Centre is not permissible in the terms of the provisions of Section 435 of the Code of Criminal Procedure, 1973.

In citing the specifics of the case, the plea argued that no rational authority applying any test in any current policy would be able to grant remission to those who be involved in the execution of horrifying actions.
