SC in plea seeking investigation into deaths attributed to vaccines: Can’t doubt vaccination

New Delhi, Nov 26 : , Friday’s Supreme Court affirmed that it cannot send a false message regarding the ongoing Covid vaccination.It also stressed the fact that the WHO had also supported the vaccines.
A bench comprising Justices D.Y.Chandrachud, A.S.Bopanna stated that they could not send a message about a problem with vaccination.The WHO has endorsed vaccines.

Justice Chandrachud also stated that the revised guidelines provide another channel for monitoring serious and minor adverse events following immunisation through the ‘peripheral healthcare staff’, which includes Asha workers.He cited monthly progress reports and reiterated that it was not right to doubt vaccination at this point.

Colin Gonsalves (senior advocate), represented the petitioners and stated that the vaccine was linked to hundreds of deaths in the country at the time the petition was filed.

He claimed that healthy people who are vaccinated are dying and collapsing.

Justice Chandrachud said it could not be attributed the vaccine and asked, “What’s the correlation?”

Gonsalves responded, “Maybe.However, we must have a monitoring device to record this .”.He also stated that the 2015 AEFI guidelines were updated in 2020.This only allows passive surveillance, and relies only on the complaint of the person or family concerned.

Justice Chandrachud said, “We can’t say, we haven’t formulated guidelines AEFI India.” We have a system.There will always be dissenters.But we cannot make our policy according to them.

He said that the court must see the national good as a whole.”The world was facing an unprecedented pandemic like none before.He stated that vaccination is of paramount national importance.

Justice Chandrachud said that there will always exist studies, whether five or ten year down the track, but at this stage, “We can’t afford the price of laxity,” of not vaccinating.

We must keep people safe and reduce the number of deaths.

Justice Chandrachud stressed that “When you have guidelines why should the court interfere in this crucial stage of vaccination?” Every country has multiple vaccines.just look at the developed world, the USA.

After hearing the argument in detail, the bench requested that Gonsalves serve the petition at the office of the SolicitorGeneral.Ajay Kumar Gupta, along with others, petitioners, requested direction to the Centre to record, advertise, and follow up on any death within 30 days of immunisation.

After two weeks, the bench stated that “We have a few thoughts” and scheduled the matter for further hearing.
