BJP chief Shahnawaz Hussain moves SC challenging Delhi HC order for FIR in the rape case

New Delhi, Aug 18 : BJP leader Syed Shahnawaz Hussain has filed a motion with to the Supreme Court challenging a Delhi High Court order directing registration of FIRs against him in an alleged rape case that dates back to the year 2018.
Hussain’s lawyer requested an urgent hearing before an apex court headed by Chief Justice N.V.Ramana.The counsel argued that the client enjoys a a three decades-long career in politics, and that the registration of the FIR would sully his reputation.The highest court voted to hear the matter next week.

In his argument in the high court Hussain asserted that the court was not aware the fact that he was in a ‘illegal’ way in the case, since the lady, who was in an argument about marriage with his brother had some ulterior motive.

“The petitioner is an ‘Z’ plus security guardian, and the claims made of the complainant were proven to be completely false and false as she changed her statement and the place of the petitioner as well as the location of her never were matched according to CDRs as well as CCTV footages.” stated the plea.

Hussain stated that he had made an investigation with Delhi Police in 2017 and claimed that he resided independently from his brother Shahbaz Khan, who was a resident of Noida and a woman on her Facebook account was constantly attacking him.

On Wednesday on Wednesday, the Delhi High Court directed registration of an FIR against Hussain and ordered the completion of the investigation in three months and the filing of an elaborate report in accordance with Section 173 Code of Criminal Procedure.

The high court ruled: “In the present case it appears that there is an absolute reluctance of the police of police officers to to issue an FIR.Without the presence of an FIR at the very least the police may have, as was as was observed by the eminent special judge, carried out an investigation that was a preliminary one.”

In June, a Delhi-based lady had filed an accusation against Hussain accusing him of committing of violations in sections 376 (rape) 120-B (criminal conspiracy) and 506 (criminal intimidation) of the Indian Penal Code (IPC).

The woman claimed that the BJP leader assaulted her and threatened to murder her.She made an application to seek instructions from the Delhi Police for the registration of an FIR.
