V.Ramana Sunday stressed the importance of law enforcement agencies dealing with these cases effectively.
The remarks were made during the Fifth Late Sri Lavu Venetswarlu Endowment lecture.

In recent years, there have been more physical assaults on judges officers.

If a party does not receive a favorable order, it is possible to see coordinated campaigns on social media and print against the judges.This attack appears to have been sponsored and coordinated.

These malicious attacks must be dealt with effectively by law enforcement agencies and specialised agencies.The Court must intervene and issue orders to prevent authorities from proceeding with investigations.

He said that governments have a duty to provide a safe environment for judges and other judicial officials so they can work fearlessly.

Justice Ramana spoke out against media trials and stated that these cannot guide cases.

The rising number of media trial cases is another factor that affects independence and fair functioning of the judiciary.The new media tools are powerful amplifying devices, but they appear incapable of distinguishing right from wrong, good or bad, real and false.

He stated that media trials are not a factor for determining cases.

The CJI explained the challenges that the judiciary faces and the persistent problems they face.

He said that the Constitution allows for ample room to change, as long as it is a democratic country.

Justice Ramana stated that the judiciary must be quick to adjust and flexible in order to solve any problem that may arise.

The CJI praised the government’s appointment of several judges and debunked claims that judges have appointed them.

It is fashionable nowadays to repeat phrases like “judges themselves appoint judges”.This is a common myth.It is not true that the judiciary is only one of many involved in this process.

There are many authorities involved in the process, including the Union Law Ministry and the State Governments.The Governor, High Court Collegia and Intelligence Bureau are all responsible for evaluating the candidate’s suitability.

It is sad that even the most informed propagate this notion.This narrative is good for certain segments.

CJI noted, too that legislations cannot be passed without an impact assessment and basic scrutiny.

The minimum that can be expected of the legislature when drafting laws are that they adhere to established Constitutional principles.

They must consider providing solutions for any issues that may arise from the laws they make.These principles are often ignored.

The CJI cited the 2016 introduction of the Bihar Prohibition Act as an example and stated that it “caused the High Court to be clogged by bail applications.” A simple bail application can take one year for a decision.
