San Francisco, Nov 21, : , Apple Music was sued by the United States for copyright infringement and “false advertising” and association with transphobia.
Apple Music has been accused by the copyright holder of a song that violates the copyright to an original song.

AppleInsider reports that the song’s copyright holder also claims Apple made a profit from it by using the track in an advert online.

Charming Beats claimed that they own the copyright to a song called “Anything you Synthesize”.

The company claims that a third track, “Caramelo”, by Ninho (French rapper) contains a musical element which is not licensed reproduction.”

The website also stated that the lyrics to “Caramelo”, along with an excerpt, were featured on Apple’s website.A link is provided to Apple Music to access the entire song.

The filing stated that “Defendant Apple’s promise to stream the complete version of the Infringing Derivative on its service” was very attractive.

The suit continues, “But it” is a misleading and false advertisement.

According to reports, Caramelo was unavailable on Apple Music in that time.

Charming Beats claims that Apple’s commercial featured a DeeBaby video encouraging users to join Apple Music to hear the entire song.

According to a court filing, “DeeBaby has been widely criticised for his transphobic remarks.”

It stated that the Copyrighted Track was being associated with transphobia by the defendants.This has caused damage to the Copyrighted Track.

The case is believed to date back to 2017, when Charming Beats stated that it issued take-down notices to Apple and MediaLab.

Company wants to be tried by a jury and receive damages up to $150,000, but no less than $30,000 plus all costs.
