On November 8, the top court had expressed its dissatisfaction with the SIT probe in the Lakhimpur Kheri violence incident with regards to the seizure of mobile phone of only one accused and the process of collection of evidence in the two FIRs.

The top court expressed dissatisfaction on November 8 with SIT’s probe into the Lakhimpur Kheri incident of violence.This included the seizing of mobile phones of one suspect and collecting evidence through the FIRs.

Justice Kant said: “What appears to us is that SIT is unable to keep the investigative distance between the FIRs (one where farmers were mowed down by the car and the other accused were killed)…important to ensure evidence in 219 and 220 (FIRs) recorded independently”.Justice Kant stated: “We believe that SIT cannot keep an investigative distance between FIRs [one in which farmers were run over by the car, and another where the accused were killed important to secure evidence in 219 (FIRs),”Justice Kant explained that SIT was unable to maintain the investigative separation between FIRs.One where farmers were hit by the car; the other were fatally mowed down important.

This is to make sure evidence is recorded in separate 219/220 FIRs.

The bench, stating it is not confident regarding the process adopted by Uttar Pradesh SIT to record the evidence, said: “We are inclined to appoint a judge from a different high court to monitor day-to-day investigation…till the charge sheet is filed.”According to the bench, it was not sure about the Uttar Pradesh SIT’s process to record evidence.It stated: “We are inclined [to appoint] a judge of a higher court to supervise day-to-day investigations…till we file the charge sheet.”While the court expressed doubts about Uttar Pradesh SIT’s recording of evidence, the bench stated that it would be inclined to name a high-court judge to oversee the day-today investigation until the charges are filed.

The violence occurred on October 3, resulting in the killing of eight persons, including four farmers who were allegedly mowed down by the vehicles in the convoy of Ashish Misra, the son of Union Minister and BJP MP Ajay Kumar Misra.
