Chennai 22nd, August : The Madras High Court on Monday delayed the hearing of the petition that was filed by former Chief Minister as well as AIADMK chairman Edappadi K.Palaniswami challenging the ruling of one judge of the Madras HC in favour of his opponent in the party O.Panneerselvam.The case is scheduled to be considered by the second division bench made up of Justices M.Duraiswamy and Sundar Mohan on Tuesday.
On the 17th of August the 17th of August, one bench of Justice G.Jayachandran had issued common decisions on three applications that were filed by Panneerselvam and general council member of the party Varimuthu.Although only one appeal was mentioned on Monday the former AG of Tamil Nadu and senior lawyer Vijay Narayan representing Edappadi K.Palaniswami strongly attacked the decision made by the judge on a single bench in favor of Panneerselvam.
The advocate argued that , even since the general council meeting was scheduled to be heard by the judge and the judge, the judge extended the hearing to the general council meeting on June 23.The senior lawyer claimed that the general council meeting was an additional issue and a lawsuit was filed by a member of the general council of AIADMK.M.Shanmugham in that case before the Supreme Court of India.
Advocate Narayan claimed that the judge on a single bench did not need to have considered the events of June 23 because the issue was already in the Supreme Court of India.
He added that the second decision of the judge of the single bench on the absence of an executive or general council without the permission of the Joint Coordinator and Coordinator of the party.Coordinating Committee of the party caused the formation of a virtual deadlock in the party since there was no chance of the twothe former Panneerselvam and his client Palaniswami working together.
Justice Duraiswamy intervened in between the arguments and stated that his bench would hear the appeal on Tuesday, and would not be burdened with the need to produce of an official version of the decision.
The judge stated that If the two other appeals were included on Monday, they could be listed together on Tuesday.
