SC keeps Jharkhand HC proceedings on petitions for CBI, ED probe against Hemant Soren

New Delhi, Aug 17 : The Supreme Court on Wednesday stayed the proceedings in the Jharkhand High Court on PILs filed against Chief Minister Hemant Soren, accusing him of financial fraud and other irregularities in granting mining leases and reserved its decision on pleas made by the state government as well as Soren contesting the validity of the PILs in the high court.
A bench , headed by Justice U.U.Lalit and consisting of justices Ravindra Bhat and Sudhanshu Dhulia declared: “Order reserved.Because the court is in possession of the issue and has been notified, the high court will not proceed with the writ petitions.”

State government as well as Soren had moved the highest court to block the high court’s decision that recognized the validity of PILs that sought an ED/CBI investigation against Soren.

Following hearing arguments, the highest court was of the notion that neither petitioner or the ED could prove their case.The court also asked the ED what it was doing to remove the petitioner from the PIL petitioner’s shoulders if it had solid evidence in the case.

The highest court also did not take into consideration “evidence in sealed cover” and instead asked the ED to establish prima-facie evidence.

Senior lawyer Kapil Sibal, who represents the Jharkhand government, has questioned the validity of the PILs and claimed that the petitioner was not able to make an FIR but instead, they approached the court of appeal in the case.

Additionally the PIL was not in conformity with the Jharkhand High Court PIL rules.Sibal said that the court ruled on the maintainability of the case even before the entire document was in front of it.

The court of appeals observed that Soren already owned these lands prior to the time he took office, and that it was not like the office was used to accumulate wealth.Senior attorney Mukul Rohatgi, who represented the Chief Minister said that there was not a initial approval of the court of appeals in the case.

Additional Solicitor General S.V.Raju representing the Enforcement Directorate (ED), presented before the highest judge that the petitions shouldn’t be dismissed due to technical reasons and that technicalities shouldn’t be a factor in the way in the case.

In June the Jharkhand High Court had ruled that two petitions for CBI and ED investigation into Soren in the context with the allegations of irregularities in the granting of mining leases as well as the transactions of certain shell companies are able to be maintained.

The state government as well as the Chief Minister filed a petition to the apex court to challenge the high court’s decision.

PILs were filed in the case of Soren as well as his relatives.

The issue is related to the lease to mine stone by Soren to himself in 2021 and he gave up on February 4, 2018.The other PIL stated that Soren and his family members were allegedly involved in storing unaccounted for money in the shell company through associates.
