Earlier, the court had reserved its decision on the point-of-concern on the CBI–ED charge sheet in Aircel Maxis involving Chidambarams & others.

Additional Solicitor General Sanjay Jain representing probe agencies had previously informed the court that agencies had sent Letters Rogatory — documents requesting information through a foreign court — to different countries. There have been some developments on that.

CBI had previously stated that it was working on a new lead. Both agencies filed the status report in court earlier.

The court had previously directed agencies to file a status update in the Aircel Maxis case involving P.Chidambaram’s son Karti Chidambaram. This was postponed sine die.

While requesting reports from the agencies, the court stated that the allegations in the charge sheet appeared “quite serious”.

Predecessor Judge O.P.Saini, who granted anticipatory bail, noted that all evidence related to the commission by the accused was documentary in nature. Both accused were not liable for altering it.

The CBI and ED are investigating the case to determine if there were any irregularities in the approval of Foreign Investment Promotion Board in the Aircel Maxis deal.

According to the probe agencies, the approval was granted in 2006, when P.Chidambaram was Union Finance Minister.

According to the rules and the foreign direct investments policy in force at the time, Chidambaram was allegedly authorized to approve proposals involving foreign investment up to Rs 600 crore.

Chidambaram is accused of withholding Foreign Investment Promotion Board (FIPB), clearance of the deal until Karti Chidambaram received five percent.
