Bombay HC rejects Tejpal’s request for in-camera proceedings

Panaji, Nov 24, : .The Bombay High Court rejected the plea of Tarun Tejpal, former editor-in-chief of Tehelka, to hear in-camera the ongoing appeal proceedings in connection to a 2013 case of rape.

Tejpal sought relief from the High Court pursuant to section 327(iii) of Code of Criminal Procedure.This section states that an enquiry or trial in a case of rape under sections 376A, 376B and 376C of the Indian Penal Code must be conducted in-camera.

The Goa government appealed against Tejpal’s acquittal in the rape case brought by his junior colleague.He had accused Tejpal of raping her twice at a five-star resort in Goa in 2013.

Tejpal’s lawyer Desai demanded that the case be heard in-camera.He said that the appeal filed by Goa government could be considered an ‘enquiry’ which falls within the scope of section 327 CrPC.

“Because section327 is intended to protect both the reputation of the complainant as well as the accused.Desai stated Wednesday that reputation is a fundamental right and not (just) a statutory duty to the Bombay High Court.

Tushar Mehta, the Solicitor General of India, is representing the state government.However, he argued that the plea for an in-camera hearing was not covered by the same CrPC section.

“The appeal is not an inquiry or a trial.The trial ends when the judgment is made.Mehta stated that Section 327 is only for an inquiry and a trial.

The appeal case was scheduled for hearing by the HC on December 6, while Tejpal sought to appeal against the HC’s order on Wednesday.
